How do I deal with the Buyer’s request to delay closing?

G’day,

The buyer needs to extend out closing date by 2mths.

What is a reasonable penalty to charge the buyer? Typical cost involved- home insurance- property taxes – heating – opportunity cost from the proceeds of the sale.

TIA

Nick’s Response:

Delayed closings are a common concern in real estate transactions. Understanding the typical causes and how to address them can help mitigate potential issues.

Common Causes of Delayed Closings:

  1. Financing Issues: Delays in mortgage approval or last-minute changes in loan terms can postpone the closing date.

  2. Title Problems: Discovering liens, disputes, or other title defects can halt the process until resolved.

  3. Inspection and Appraisal Delays: Scheduling conflicts or issues found during inspections and appraisals can require additional time to address.

  4. Document Preparation: Incomplete or incorrect documentation can lead to postponements.

  5. Buyer or Seller Contingencies: Unmet contingencies, such as the sale of the buyer’s current home, can cause delays.

Managing and Preventing Delays:

  • Stay Organized: Keep all necessary documents readily available and respond promptly to requests from your real estate agent or lender.

  • Communicate Regularly: Maintain open lines of communication with all parties involved to quickly address any arising issues.

  • Set Realistic Timelines: Understand that some processes take time; setting realistic expectations can help manage stress.

  • Have a Contingency Plan: Be prepared for potential delays by having flexible arrangements for moving dates and temporary housing if needed.
